翻译作品的著作权问题
本人接到咨询电话，询问其将国外的作品翻译成中文，发表在杂志上，杂志支付了他稿费，他想问这篇翻译作品的著作权归属问题，他这样是否侵犯了原作者的权利。
每个国家的《著作权法》都可能有不同的规定，这个咨询人的作品涉及到国外的作品，我们无法判断按照这个国家的规定是否构成侵权。我国《著作权法》第十二条规定：“改编、翻译、注释、整理已有作品而产生的作品，其著作权由改编、翻译、注释、整理人享有，但行使著作权时，不得侵犯原作品的著作权。”下面根据我国法律规定进行分析：
1、翻译作品的著作权归属翻译人享有。
按照我国《著作权法》的规定翻译作品的著作权归属翻译人享有。
2、翻译作品是否要经过原作者的同意？
请注意法律规定，法律明确规定翻译的原作品只能是已有的作品，这个“已有”，我的理解是已经发表的作品。那么原作品有两种，一是已经发表过的，二是没有发表过的。翻译已有的作品，根据法律的规定是不需要作者同意的；如果是没有发表的作品是否可以翻译，法律没有明确规定，从著作权法的立法原意来理解，应当经过作者的同意，否则侵犯了原作品的发表权。
